They ARE winning and the defeated infidels have to accept Hamas' terms. Israel has not given any impression it even wants to win. So why shouldn't Ismail Haniyeh dictate the terms? Its not like Israel - in the person of Ehud Olmert - wants to even destroy Hamas. What Olmert wants is political breathing room and his interests and that of Israel aren't necessarily identical.
